Agreement to Terms

By downloading, installing, or using Sunpath ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Sunpath is a mobile application that provides augmented reality visualization of sun positions and calculates solar data for educational and informational purposes. The App uses astronomical algorithms to estimate sun positions based on your location, date, and time.

License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on a device that you own or control.

Restrictions

You agree not to:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices from the App
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the App

Accuracy and Limitations

While we strive for accuracy, Sunpath provides estimates based on astronomical calculations. The App's data should be used for general informational purposes only.

Important limitations:

  • Sun position calculations are estimates and may vary from actual positions
  • Compass accuracy depends on your device's sensors and local magnetic interference
  • The App does not account for obstructions such as buildings, trees, or terrain
  • Weather conditions are not factored into sunlight calculations

Do not rely solely on this App for decisions with significant financial, safety, or legal implications. We recommend consulting with qualified professionals for important property assessments.

Intellectual Property

The App and its original content, features, and functionality are owned by Sunpath and are protected by international copyright, trademark, and other intellectual property laws.

Payment and Refunds

The App is available for a one-time purchase price. Payment is processed through the Apple App Store or Google Play Store. Refund requests are subject to the respective store's refund policies:

  • Apple App Store: Request refunds through Apple at reportaproblem.apple.com
  • Google Play: Request refunds through Google Play's refund process

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUNPATH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any decisions made based on information provided by the App
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the App

Indemnification

You agree to indemnify and hold harmless Sunpath and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the App or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer is located, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
